Administrative Rules Proposed for Adoption

The State Health Plan accepted oral public comments at the February 25, 2019 meeting of the Board of Trustees of the State Health Plan.  The State Health Plan also accepted written public comments on these proposed rules beginning on February 12, 2019, through March 14, 2019. The State Health Plan has reviewed and considered all feedback received. The State Health Plan does not intend to make any substantive changes to the rule language proposed. However, please note the citation change to reflect the codified reference.

The State Health Plan hereby adopts these four rules as proposed. (Click on each to view the entire rule):

SHP-POL-3004-SHP, Enrollment Exceptions and Appeals Policy and Procedure is adopted as 20 NCAC 12 .0101(a), SHP Rule on Enrollment Exceptions and Appeals.

SHP-POL-3009-SHP, Policy on Member Terminations and Reinstatements is adopted as 20 NCAC 12 .0101(b), SHP Rule on Member Terminations and Reinstatements.

SHP-POL-3005-MUL, Policy and Procedure on Arrears is adopted as 20 NCAC 12 .0101(c), SHP Rule on Arrears.

The following new rule is adopted as 20 NCAC 12 .0101(d), SHP Rule on Retiree Health Benefit Enrollment and Premium Payments.

The State Health Plan is authorized to adopt rules in accordance with the authority granted in N.C. Gen. Stat. § 135-48.25.  The State Health Plan is exempt from the rulemaking procedures of the Administrative Procedure Act per N.C. Gen. Stat. § 150B-1(d)(7).  However, these rules will be submitted for codification in the North Carolina Administrative Code in accordance with N.C. Gen. Administrative Rules Proposed for Adoption

This is to give notice that the State Health Plan intends to adopt administrative rules, which have previously been set by informal policies.  These rules are necessary for the State Health Plan to administer and carry out its fiduciary responsibilities to provide comprehensive health benefits under Article 3B of Chapter 135 of the North Carolina General Statutes. 
 
The following existing policies are proposed to be adopted as rules (click on each to view the entire rule):
 
SHP-POL-3004-SHP, Enrollment Exceptions and Appeals Policy and Procedure is proposed to be adopted as SHP-RULE-3004, SHP Rule on Enrollment Exceptions and Appeals.
 
SHP-POL-3009-SHP, Policy on Member Terminations and Reinstatements is proposed to be adopted as SHP-RULE-3009, SHP Rule on Member Terminations and Reinstatements.
 
SHP-POL-3005-MUL, Policy and Procedure on Arrears is proposed to be adopted as SHP-RULE-3005, SHP Rule on Arrears.
 
The following new rule is proposed for adoption:
 
SHP-RULE-3011, SHP Rule on Retiree Health Benefit Enrollment and Premium Payments.
 
The State Health Plan will accept public comments on these proposed rules beginning on Tuesday, February 12, 2019, through Thursday, March 14, 2019.  Written comments may be emailed to shprulefeedback@nctreasurer.com.  Please indicate which rule your comment addresses.  Additionally, if your comment addresses specific language, consider suggesting alternative language for the Plan’s consideration.
 
The State Health Plan will accept oral public comments at the next meeting of the Board of Trustees of the State Health Plan.  Comments from the public will be permitted to be made during the public comment period of the meeting.  Please note, each person’s time to comment may be limited at the discretion of the State Health Plan Board of Trustees Chairman.

At the conclusion of the comment period, the Plan will review and consider all feedback received.  If the Plan makes substantial changes to the rule language currently proposed, then the Plan will repost notice and solicit additional public comments.  If no substantial changes are made, then the proposed effective date of these rules is March 15, 2019.
